On October 29, a jury ruled in favor of 3M in the fifth bellwether trial in the Combat Arms Earplugs Version 2 (CAEv2) litigation. We are pleased with today’s verdict, which demonstrates once again that the CAEv2 product was effective and safe to use. We look forward to defending ourselves and our product in the two trials scheduled to start on Monday and in all upcoming trials.
While we do not yet know how many plaintiffs’ claims will actually be subject to litigation, we do know for certain that the universe of those cases is smaller than the number of claims plaintiffs’ counsel has placed on the administrative docket and cited in media materials. As 3M has previously shared, the number of claimants on the administrative docket in this matter is not an accurate proxy for the number of cases that will be filed on the active docket.
Additionally, plaintiffs’ lawyers have already dismissed several bellwether cases — more than the cases that have been tried to date. 3M will continue to vigorously defend these cases and demonstrate that the CAEv2 product was effective and safe to use at all times.
