On April 8, a Pensacola jury ruled in favor of 3M in the ongoing Combat Arms Earplugs Version 2 (CAEv2) litigation. This brings 3M to six wins out of the 14 trials brought before juries to date.

3M is pleased another jury has sided with the defense. We have now won nearly half of the bellwether trials, in addition to the eight cases plaintiffs’ lawyers have dismissed before they reached trial. This multi-district litigation’s mixed record demonstrates the strength of 3M’s case and the significant challenges plaintiffs face in proving their claims.

This latest defense verdict follows 3M’s appeals, calling out the legal defenses and evidentiary ruling issues that have been present throughout the bellwether process. A ruling in favor of our appeals could significantly alter the progression and outcome of this litigation.

The next bellwether trial is scheduled to begin in Gainesville, Florida, on April 18. We remain confident in our case and look forward to defending our product and our record.
